Enforcement of Judgments from a Foreign Country

The holder of a judgment from a foreign country may file suit in the Massachusetts courts to enforce the judgment under Massachusetts law. Massachusetts has adopted, M.G. L. c. 225 sec. 23A, which is modeled on the Uniform Foreign Money- Judgments Recognition Act. It provides for the recognition and enforcement of a final monetary judgment from a foreign country under certain circumstances. For example, the Massachusetts court will not enforce a judgment rendered under a system which does not provide impartial tribunals or procedures compatible with the requirements of due process of law.
